The CPC for US toy imports: who signs it and what goes on it

What CPSIA changed

Before 2008, a US importer could place a toy on the market on the strength of a supplier's word and a lab report in a drawer. The Consumer Product Safety Improvement Act replaced that with a certification system: products for children must be tested, and the importer must issue a written certificate before the goods enter commerce.

For a wooden toy the relevant rules are ASTM F963-17 (16 CFR 1250), the lead limits in substrate and surface coatings, the phthalate limit for plasticised parts, and the small-parts and tracking-label rules. Every one of them has to be cited on the certificate.

Who actually signs it

The CPC is issued by the importer or the domestic manufacturer. Not by the Chinese factory, and not by the laboratory. The factory supplies test reports and production data; the laboratory tests; the party that puts its name on the US market certifies.

In practice the factory drafts the document, because it holds the model numbers, the paint list and the test dates. You review it, correct the entity name and address, and sign. If your customs broker sees a certificate naming the factory as certifier while the entry names you as importer of record, expect a query.

That said, a foreign manufacturer may certify in its own name if it is the one importing. Most of our customers are not in that position, so the certificate goes out under their letterhead.

What has to be on the document

16 CFR 1110 lists the elements. A certificate missing any one of them is defective even if every test passed.

Write it in English, on one page where possible, and keep the model numbers identical to the commercial invoice. Most rejections are clerical, not technical.

Children's certificate versus general certificate

A Children's Product Certificate covers products designed for children twelve and under. A General Certificate of Conformity covers everything else that is subject to a consumer product safety rule. Wooden toys are children's products, so the CPC is the one you need.

The difference is not cosmetic. A GCC may rest on the manufacturer's own testing programme. A CPC must rest on testing at a CPSC-accepted third-party laboratory. If someone offers you a “CPC” issued without third-party testing, it is not a CPC.

Testing at a CPSC-accepted laboratory

The lab has to be accepted by the CPSC for the specific test category. Plenty of capable Chinese laboratories hold CNAS accreditation and ISO 17025 scope without CPSC acceptance for toys. A report from one of those is useful evidence but does not support a CPC on its own.

Check the acceptance list before you commission anything, and check that the model tested is the model shipping. Cosmetic changes — a different paint colour, a different printed box, a substituted dowel — can put the shipment outside the tested configuration.

CPSIA also expects periodic testing of products in ongoing production, not one test at launch. If you reorder the same SKU next year, confirm with the lab whether the existing report still covers it or whether a new sample set is required.

Tracking labels are part of the package

A CPC without a compliant tracking label is half a file. The label must be permanently affixed to the product and to its packaging, and it must carry the manufacturer or importer name, the location and date of production, and a cohort or batch identifier that ties the unit to the test record.

For wooden toys the practical problem is the product label. A sticker on the base of a block is easy; a sticker on a painted arch is not, and a label that falls off in a playroom fails the “permanently affixed” test. Plan the marking with the factory at sampling stage, not at packing stage.

Why a CPC gets held at customs

US Customs and Border Protection does not audit every entry, but when it looks, it looks at documents. These are the failures we see most often.

  • The certificate names the factory as certifier while the entry names the importer.
  • A rule is missing from the citation list — usually phthalates, or the tracking-label rule.
  • The product description does not match the entry line or the invoice.
  • No laboratory identified, or a laboratory without CPSC acceptance for toys.
  • Testing date predates a design or paint change.
  • Place of manufacture left blank, or given as “China” with no city.
  • No tracking label on the shipped units, so the certificate cannot be tied to the lot.
  • An unsigned certificate, or one signed by someone with no authority to bind the importer.

Each of these is fixable in an hour while the goods are still at the factory, and expensive once the container is on the water.

Records retention

Keep the certificate, the underlying test reports, the lab's accreditation details and the production records for five years. The clock starts with the date the certificate is issued, and it applies to the importer, not the factory. If you change importers or brokers, the file goes with the entity that certified.

Store it as a searchable folder per SKU, not per shipment. When a buyer or a regulator asks for the file on a model you shipped two seasons ago, you want the report, the CPC and the tracking-label artwork in one place.

If you are opening a US account, tell us the SKUs and we will send the test reports we hold, a CPC draft with the fields above filled in, and the tracking-label layout for your approval. Browse the baby and toddler range, review quality and certifications, or request a quote to start.
